1. Purpose
These Terms of Use govern access to and use of the NEPPS Portal and the services provided through the IIS NEPPS.
2. Scope
These Terms of Use apply to every natural or legal person accessing or using the services available through the NEPPS Portal, including the following subsystems and services:
- NEPPS Supplies & Services;
- CERPP;
- Promitheus ESPDint;
- Preliminary Market Consultations;
- the IIS NEPPS Help Centre ticketing system; and
- the CERPP Open Data API.
3. Services Provided
The IIS NEPPS Portal provides, where applicable:
- access to the electronic services of IIS NEPPS;
- information relating to public procurement;
- user guides;
- technical documentation;
- announcements;
- training material;
- access to the IIS NEPPS Help Centre ticketing system; and
- access to the documentation of the CERPP Open Data API.
4. Access
Certain services are publicly available, while access to others is granted only following successful user authentication, in accordance with the procedures established for IIS NEPPS and the applicable legal framework.
5. User Obligations
Users shall:
- use the services of IIS NEPPS lawfully and in accordance with the applicable legal framework;
- refrain from interfering with the operation of the system or making abusive use of its services;
- provide accurate, complete and up-to-date information where required;
- update their information whenever necessary;
- safeguard their authentication credentials and refrain from disclosing them to any third party;
- refrain from attempting to gain unauthorized access to the system or its resources; and
- immediately notify the Operating Authority in the event of any suspected unauthorized use of their account or any other security incident affecting their credentials.
6. Intellectual Property
Unless otherwise stated, all content available through the NEPPS Portal, including, but not limited to, text, logos, graphics, user guides, manuals and other informational material, is protected by the applicable intellectual property legislation.
Any reproduction, distribution, modification or other use of such content is permitted only where expressly authorized by the applicable legislation or by the relevant rights holder.
7. Acceptable Use of the Services
The services provided through IIS NEPPS are intended exclusively for lawful use in accordance with the applicable legal framework governing the operation of the system and the award and performance of public procurement procedures.
Users shall use the services of IIS NEPPS in a manner that does not compromise the security, availability or proper operation of the system.
In particular, users shall not:
- attempt to gain unauthorized access to any information system, data or functionality of IIS NEPPS;
- circumvent, disable or interfere with the security mechanisms implemented by the system;
- use automated tools or other technical means to perform unauthorized data collection or to place excessive load on the services;
- introduce, transmit or distribute malware or any other malicious code; or
- perform any other activity that may adversely affect the operation, security or availability of IIS NEPPS, or otherwise violate the applicable legal framework.
The Operating Authority may implement any technical or organizational measures considered necessary to safeguard IIS NEPPS and, where appropriate, may notify the competent authorities in the event of unlawful or malicious use.
8. Open Data
The CERPP Open Data are made available in accordance with the specific terms published in the relevant section of the IIS NEPPS Portal and in the documentation of the CERPP Open Data API.
The use of such open data is governed by the applicable terms of use and the Creative Commons Attribution 4.0 International (CC BY 4.0) license, as published in the relevant section of the Portal.
9. Service Availability
The services of IIS NEPPS may be temporarily unavailable due to scheduled maintenance, system upgrades or emergency technical interventions required to ensure the security, integrity or proper operation of the system.
10. Limitation of Liability
The Operating Authority shall not be liable for any interruption, malfunction or damage resulting from:
- failures attributable to third-party service providers or external infrastructure;
- failures of users' equipment or communication networks;
- improper or unlawful use of the services by users; or
- events of force majeure or other circumstances beyond the reasonable control of the Operating Authority.
11. External Links
The IIS NEPPS Portal may contain links to websites operated by public authorities, institutions of the European Union or other third-party organizations, solely for information and user convenience.
The Operating Authority assumes no responsibility for the content, availability or privacy practices of such external websites.
Users are encouraged to review the applicable terms of use and privacy policies of any external website they visit.
12. Amendments
These Terms of Use may be revised or updated whenever necessary, particularly to reflect changes in the applicable legal or regulatory framework or in the services provided through IIS NEPPS.
The latest version shall always be published on the IIS NEPPS Portal and shall take effect upon publication, unless otherwise specified.
13. Governing Law
These Terms of Use shall be governed by the laws of the Hellenic Republic and the applicable legislation of the European Union.
Any matter relating to the interpretation or application of these Terms shall be governed by the applicable provisions of Greek law.
14. Contact
For matters relating to the operation and use of the services provided through IIS NEPPS, users may submit requests through the electronic communication channels of the IIS NEPPS Help Centre ticketing system, in accordance with the instructions published on the NEPPS Portal.
